Bargaining Update #19: November 21, 2025

Bargaining continued this week on November 17-19 in Los Angeles. Our team passed proposals to management specifically addressing:

  • Advanced Hire criteria
  • ETO process/ scheduling

As of this week management has received every proposal we have to give them and the ball is in their court to respond to us. Bargaining will continue in December. When dates have been settled upon those will be announced to the membership.

Acupuncturists and therapists have worked together to negotiate a contract, overcoming the sometimes difficult process as they strive for a first agreement and join the existing therapist bargaining unit.

Still, our bargaining team has advanced member-driven priorities around:

  • Workload
  • Earned time off
  • Hours of work
  • Overtime
  • Fair compensation
  • A wage grid that finally includes advance-hire criteria for acupuncturists

And, we have won key Tentative Agreements (TAs) on:

  • Workload
  • Bereavement leave
  • Hours of work and overtime
  • Recognition and coverage
  • Per diem commitments
  • The inclusion of acupuncturists in union benefit plans

We continue to push for:

  • Transparent PTO processes
  • Earlier access to ESL
  • A transition agreement as the bargaining unit moves to a non-exempt status

With major economic issues now on the table, member solidarity—at bargaining, on picket lines, and through Blue Thursdays—remains essential as the team fights for a contract that respects our members work and the care they provide.

Bargaining Update #18: November 15, 2025

Bargaining Report

Your ATNC bargaining team met this week at the new UNAC/UHCP Headquarters in the City of Industry. We completed and passed our proposal for a regional Earned-Time-Off (ETO) process that ensures employees have meaningful opportunities to take the time off, while still honoring seniority and preserving appropriate local flexibility.

Management’s response rejected much of the language related to local input and added provisions that could impact transparency and the availability of PTO slots. We will continue refining our proposal to ensure it reflects our members’ priorities.

We also internally reviewed and sharpened our interests regarding the wage grid, including progression, longevity differentials, advance-hire criteria, and placement for acupuncture providers, in preparation for next week’s economic subgroup sessions at National Bargaining.

Additionally, management passed proposals on advance-hire criteria and a transition plan for moving our group from exempt to non-exempt status. We engaged in discussions about the amount of prior non-KP experience that should be considered for advance-hire, as well as the need for more concrete language around the status transition plan—such as PMT placement and clarity around appointment types that may be affected by break requirements.

National Bargaining continues next week in Los Angeles. ATNC will be represented in-person by our lead negotiator, legal team, and president, while the rest of the team participates virtually in these critical discussions.

Bargaining Update #17: November 9, 2025

Bargaining Report

Our ATNC bargaining team returned to the bargaining table in Los Angeles this week on November 4-5.

We continue to grapple with several big issues concerning Personal Time Off (PTO). We are exploring creating a default regional process for requesting PTO. The process would include clear and widely applicable guidelines while still allowing opportunity for local input regarding the details around implementation. We remain committed to establishing a process that is objective, equitable, and transparent so that members have the opportunity to take time off as needed.

We passed a Letter of Agreement (LOA) to management that obligates labor and management to explore creating a lead job classification for acupuncture providers. Our proposed LOA recognizes that there are acupuncture providers who perform duties above and beyond their standard job description, including triaging referrals and implementing acupuncture programs at the local level.

A bargaining town hall meeting is scheduled for November 11 at 7:30pm. Please watch your email for details on how to join.

Bargaining Update #16: October 30, 2025

Bargaining Report

During bargaining this week on October 28-29 our team continued to push for inclusion of contract language that would require the number of PTO slots created to match actual department accrual. Management’s reluctance appeared to be from the fact that a non-exempt (hourly) status would require employees to consume more PTO for activities other than vacation, such as medical appointments. Further internal discussions have been scheduled to ensure our members have access to their well-deserved time off. We anticipate a Tentative Agreement on this article in the near future.

We reached a Tentative Agreement on Hours of Work and Overtime. Highlights include:

  • No-cancellation language for extra hours/shifts (for all employees) which was a considerable win, as management initially insisted on their right to cancel extra shifts at the last minute.
  • ⁠Retention of our current language defining evening and night shifts, which are subject to differentials.
  • ⁠Acknowledgement that approval of overtime is not always feasible prior to its occurrence, due to the nature of our work.
  • ⁠A commitment to a period of transition and training as we move from exempt to non-exempt.
  • ⁠Memorialization of the current practice of trades, temporary schedule changes, and self-coverage.

Next up our bargaining team’s focus will intensify on resolving our outstanding economic issues. PTO accrual, wage grid structure, as well as advanced hire criteria will be the focus of our discussions as the Economic Subcommittee at National Bargaining continues to negotiate unprecedented across-the-board wage increases for the Alliance Unions.

Bargaining Update #15: October 24, 2025

This week during bargaining on October 22-23, we continued discussions addressing the language around evening and night differentials, stressing the importance of maintaining the current shift definitions to avoid disadvantaging therapists working later shifts.

Regarding the proposed movement of ATNC members who are currently in exempt status moving to non-exempt status, management reconfirmed their commitment not to cancel any regularly scheduled shifts. We continue to seek solutions on how to approach timelines around cancellation of extra shifts/hours while maintaining flexibility for both sides.

In support of our interest to include work location and setting in the definition of “schedule” our team demonstrated through multiple examples why we view this to be necessary. Management rejected all language that would tie either to the posting of schedules, insisting on the need for flexibility and the right of management to shift staff where needed up to and including at the last minute. We will continue to push for better protections around how scheduling is approached.

Lastly, we discussed how PTO slots are created and made available for usage throughout the year. Our interest to create enough slots to accommodate the accruals of the department over the year continues to meet with resistance from the management side.

Our next bargaining sessions are scheduled for October 28-29 in Los Angeles.

Bargaining Update #14: September 29, 2025

Our ATNC bargaining team worked hard last week on passing a comprehensive package proposal around all of our outstanding Articles:

  • PTO
  • Hours of Work and OT
  • Workload
  • Compensation
  • Replacement Wage Grid proposal

Our wage grid proposal is critical, as we will seek to place our Acupuncture providers on it for the first time as well as incorporating advanced hire criteria for attracting new providers of all types into our bargaining unit moving forward. Significant progress on these issues will be a necessary contingency as we investigate potentially converting our entire bargaining unit to non-exempt status..

While no management response was formally given to our package proposal, we are anticipating one, along with our awaited response to our seniority proposal, when we resume Monday, September 29 at the Wyndam hotel in San Diego.

Bargaining Update #13: September 20, 2025

Bargaining Report

During three days of bargaining this week on September 17, 18 and 19 we are pleased to announce that our team reached Tentative Agreement (TA) with management on the following:

  • Use of gender neutral language throughout CBA
  • Establishment of per diem commitment (preserves the privilege of per diem employees to provide availability and maintain existing work commitments to the employer)

In less exciting news management passed to us a proposal outlining a choice of status for our bargaining unit members.

The choice is outlined as:

  1. All members currently under exempt status change to non-exempt status, or
  2. All members currently under exempt status remain exempt (however any preferential pay practices currently enjoyed under the existing contract as well as any differentials in pay that were established are eliminated for those members.)

At this past Wednesday’s ATNC town hall meeting we extensively reviewed the Employer’s radical proposal. During the meeting, many members asked whether or not there was a choice to remain exempt with the preferential pay practices in place. Unfortunately, status quo is only in place while we are still covered under the terms of the current contract. Under the Union’s duty to bargain in good faith, we must respond to the Employer’s proposal.

Bargaining Update #12: September 13, 2025

UTNC and APU Have Joined to Become: Acupuncturists and Therapists of Northern California (ATNC)

Our New Affiliate, and Bargaining Report

We are pleased to announce the name of our newly combined affiliate, the Acupuncturists and Therapists of Northern California (ATNC). Together we will move forward in contract bargaining and in solidarity with one another. Welcome sisters and brothers to ATNC!

Over three days of bargaining this week on September 9, 10, and 11 we reached Tentative Agreement (TA) on two matters of importance:

  • Recognition and Coverage
  • Letter of Agreement on accretion of acupuncture providers into union benefits plans

There is more work to do before we have a complete contract and we will continue to push for improvements for our members at every opportunity.

We remain far apart from management on several important issues, including:

  • Workload
  • Hours of work and overtime
  • Earned Time Off

And, we have not received a response from management on our economic proposals which are inclusive of advance hire placement. For reference our economic proposal was submitted to management in mid-July.

Management continues to suggest that a change from exempt status to hourly status would be a positive. We have asked management for a list of ways that such a change would prove beneficial to our members and they have not provided anything new to support the idea.

Bargaining Report & Welcoming the APU!

The United Therapists of Northern California and Acupuncture Providers United are now merged to form a newly combined bargaining unit! We are very excited to see our ranks grow and move into the future together. A new name for our affiliate is forthcoming but not yet decided. Until then we march forward together as UTNC.

In bargaining this week on August 25 & 26 we received responses from management on proposals we previously passed to them including:

  • Grievance and Arbitration
  • Lactation accommodation
  • Just culture
  • Workload
  • Vacancies
  • Seniority
  • Non-discrimination

None of managements counter proposals are structured anywhere close to the improvements we are seeking at the tables, and it is clear they are leaning hard into maintaining the status quo. The most consequential matter of discussion we had regarded workload. Management countered to us separate Letters of Understanding (LOU) on the workload issue, one each for Therapists and Acupuncturists. They stated clearly that they do not want workload matters handled by way of contractual language. They are amenable to supporting local workload committees and introducing a regional workload committee, however we will need to see significant safeguards to ensure their effectiveness to move forward. Management also shared that they do not want any topics currently covered via the Alliance National Agreement introduced into our local agreement, leading us to question their commitment to the partnership and their intent to do what is right moving forward.

Regardless we will not be discouraged and will continue driving to gain improvements over the status quo at each and every opportunity. Thank you to the many members who attended in person on August 25 and 26! Bargaining continues on September 9, 10, and 11 in Los Angeles at the Intercontinental hotel, where we are expecting management responses to several important matters including:

  • Hours of work and overtime
  • Earned Time Off
  • Compensation

UTNC Bargaining Update #10: August 22, 2025

Bargaining in L.A.

This week at bargaining, on Tuesday, August 19, our team welcomed a change of scenery as we moved bargaining southward to Los Angeles.

The issue gaining the most attention on the day was workload. We continue to be far apart on solutions but did continue healthy discussion about how we may find them. Management brought back the specter of how, in their opinion, changing the bargaining unit to non-exempt status could be perceived as a positive but our team continues to highlight member preference to remain exempt. We informed management that we are currently exempt, expect to remain exempt, and will write our proposals to reflect this.

A new day has been added to our bargaining calendar next week on Tuesday, August 26, and we will also be bargaining on Monday, August 25, as previously scheduled. Both sessions will be in Oakland at the Marriott City Center hotel. Our team is planning to submit counterproposals on workload on Monday, August 25 and members are encouraged to join us in person if you can.

UTNC Bargaining Update #9: August 17, 2025

This week across two days of bargaining, on August 11 and 12, our optimism was renewed as a more positive vibe was in the air and we progressed very efficiently through discussion points.

The highlight of the week was reaching our first Tentative Agreement (TA) and hopes are up that this lays down a marker for accelerating future progress! The TA covers bereavement leave.

We have moved the next bargaining session on August 19 to Los Angeles. We will be bargaining at the Intercontinental hotel located downtown. This will coincide with National bargaining which will also be underway at the Intercontinental and we will push to continue building on the momentum we have recently gained.

UTNC Bargaining Update #8: August 7, 2025

Last week on July 31, and August 1, our UTNC bargaining team was back at the bargaining table.

Meaningful progress via interest-based discussions has been made toward improving bereavement leave and establishing per diem commitment language. Unfortunately, we haven’t yet had meaningful movement on important issues like Workload, Paid Time off, Hours of Work and Overtime, or Compensation.

At the last session, instead of passing a counter to us on our comprehensive workload proposal management issued a revised workload Letter of Agreement (LOA). The revised LOA moves to end local workload committees without setting any regional workload standards. We have and will continue to emphasize the value and importance of local workload committees and prescriptive regional standards around the work we do.

Additionally, KP passed a proposal to us that would reclassify all members from exempt status to non-exempt status. Our membership has strongly expressed their desire to remain exempt, and we are tailoring all our CBA language to accurately reflect our exempt status.

While progress has been slow we remain committed to our task of continuing to bargain in good faith and of ultimately making important improvements to our contract.

UTNC Bargaining Update #7: July 14, 2025

Our UTNC bargaining team was back at the table on July 10 & 11 in Oakland, pushing forward proposals to secure meaningful improvements for our members.

We’re pleased to report that KP management returned our Bereavement Leave proposal with improved language that benefits all providers.. We’re optimistic that we’ll reach a tentative agreement on this article at our next session.

During these sessions, our UTNC team passed several key proposals to management:

  • ✅ Earned Time Off/PTO: Proposed reducing the waiting period to access the ESL bank and enhancing flexibility, transparency, and the ability for providers to use their PTO.

  • ✅ Hours of Work and Overtime: Focused on increasing schedule flexibility, improving differential pay for weekend and evening work, and securing holiday differential pay for per diem staff—all while maintaining our unit’s exempt/salaried status in response to member feedback.

  • ✅ Compensation: Proposed a wage grid structure aligned with our Southern California affiliate (UTSC), including clear advance-hire criteria and a competitive across-the-board salary increase for all providers.

UTNC bargaining continued on June 2 and June 3 in Sacramento. After a promising first day of sharing interests around workloads that support patient care delivery and therapist retention the process stalled around options to address the interests. Therefore, our team passed a comprehensive workload proposal that addresses the challenges our members have expressed across the region.

It has been and continues to be our hope that during these bargaining sessions we can achieve greater alignment with management on this and other matters, and we remain committed to winning the improvements our members need to continue to provide the highest level quality care to our patients at Kaiser Permanente.

Management has choices to make around a number of interests we have brought forward in bargaining this year. Our team is and will continue to work intently on reaching solutions when they are ready to meet the moment.

UTNC Bargaining Update #5: May 30, 2025

Recap

This week, your UTNC bargaining team engaged in two full days of interest-based discussions centered on workload—an issue that continues to impact our ability to provide safe, high-quality care. The conversations were productive, and we’ll be continuing this important dialogue during our next bargaining sessions on Monday and Tuesday of next week.

We are also preparing a proposal for a new wage grid tailored to our affiliate. Our research department is currently finalizing the costing, and we look forward to presenting a data-driven approach that reflects the value of our work.

We were also joined at the table by UNAC/UHCP Executive Vice President Peter Sidhu, whose presence underscored the importance of the work we’re doing together to build a stronger contract.

UTNC Bargaining Update #4: May 22, 2025

Recap

This week, the UTNC bargaining team began important conversations around workload—specifically addressing appropriate patient ratios across our various departments and disciplines. Our initial discussions focused on identifying opportunities to optimize access to care for Kaiser Permanente patients in Northern California while ensuring sustainable workloads for therapists.

Management presented a proposal to update the contract language on Bereavement Leave to align with current California law. We will be reviewing this proposal closely.

We remain committed to advancing our mutual interests around workload and access through an Interest-Based Problem Solving (IBPS) approach. These discussions will continue when bargaining reconvenes Wednesday, May 28 and Thursday, May 29 at the Oakland Marriott.

UTNC Bargaining Update #3: May 4, 2025

Small Steps
This week on May 2 our team reconvened with management to continue bargaining our next contract.

We engaged in frank discussions throughout the day over our identified interests including just culture, grievance and arbitration, and lactation accommodation ultimately ending on a positive note to end the day.

Management passed a proposal to our team regarding Per-Diem Commitment and we received it favorably. We have not yet reached agreement on the proposal and will continue to refine the issue at our next session.

Our UTNC bargaining team continues the important work of developing interests for 2025 local bargaining. This week we passed a comprehensive and definitive list of our interests to management. UTNC Bargaining Update #1: April 3, 2025

Excellent first day
We had a strong start to interested-based bargaining when we met with management on April 1-2, 2025 in Oakland, CA.

Our bargaining team and the employer agreed to ground rules to establish and maintain a productive bargaining process.

We emphasized recruitment and retention of high quality employees in our bargaining unit, and Kaiser management expressed similar interest.

UTNC Bargaining Kickoff: March 26, 2025

Our UTNC bargaining team met with the management bargaining team for the first time yesterday.

Together, we all received training in interest-based bargaining (IBB). IBB is the process we use to bargain contracts with KP. It’s meant to be a collaborative approach in which we explore interests to come to mutually acceptable solutions to issues facing either side during contract negotiations.
