Legal Counsel

LEGAL COUNSEL
Based in: Headquarters (City of Industry, CA) 

United Nurses Associations of California/Union of Health Care Professionals (UNAC/UHCP) is expanding its legal department and seeks an attorney who is committed to being a part of the labor movement and enforcing the rights of healthcare workers. This is a dynamic position that requires the attorney to collaborate and creatively strategize with UNAC/UHCP staff, affiliate officers, and governing boards on matters related to improving the working conditions of 42,000 healthcare workers in California and Hawaii.

Who We Are

UNAC/UHCP is made up of 100-plus employees and 40-plus affiliates and growing.  We are affiliated with NUHHCE, AFSCME, and the AFL-CIO.  UNAC/UHCP is a collegial working environment in which the open and frequent exchange of ideas is encouraged and expected. The legal department comprises three attorneys and an administrative assistant. The legal counsel is part of the UNAC/UHCP leadership team and is a non-union position. This position works under the general direction of, and reports to, the Legal Director.

ESSENTIAL DUTIES (Include but are not limited)

  • Managing a substantial and varied caseload that includes arbitrations, unfair labor practice charges before the National Labor Relations Board, and grievance mediations.
  • Identifying legal issues and advising on how to address them consistent with the goals and objectives of UNAC/UHCP, its affiliates, and its members.
  • Investigating, researching, and analyzing facts and law to advise UNAC/UHCP governing boards, staff, affiliate officers, and members on issues of labor, employment, and other laws.
  • Negotiating collective bargaining agreements as first chair or as legal advisor.
  • Advising staff on collective bargaining issues, contract enforcement, organizing, union finances, and union governance.
  • Prosecuting election petitions before the National Labor Relations Board.
  • Providing regular trainings to UNAC/UHCP staff, affiliate officers, and members on labor laws.
  • Providing legal review of UNAC/UHCP publications and Know Your Rights communications.
  • Guiding a member-led grievance committee on approving grievances for arbitration.

MINIMUM QUALIFICATIONS:

  • Juris Doctorate from an accredited law school.
  • Membership or ability to waive in as a Registered In-House Counsel in the State Bar of California.
  • At least three years’ experience practicing union-side labor law.
  • Ability to write quickly and effectively to a wide variety of audiences including arbitrators, the National Labor Relations Board, employers, UNAC/UHCP staff, and rank-and-file members.
  • Ability to speak persuasively to arbitrators and UNAC/UHCP staff, leaders, members, and unorganized health care professionals on legal topics.
  • Ability to analyze complex legal issues thoroughly and to convey the analysis with precision in writing and verbally.
  • Ability to work collaboratively in a team.
  • Ability to manage multiple priorities and complex assignments on time.
  • Ability to work with a significant degree of autonomy.
  • Ability to obtain a valid California’s driver’s license before starting employment and maintaining it throughout employment.
  • Ability to travel in California and out-of-state for work-related union actions, hearings, events, meetings, and conferences.

POSITION LOCATION

Based in California, but representation may occur anywhere UNAC/UHCP affiliates and members are located.

COMPENSATION PACKAGE

Salary $95.784/hr. – $119.143/hr. We provide a comprehensive package including medical and dental benefits for employee and dependents, optical allowance for employee and dependents, life Insurance for employee, defined benefit pension plan, 401K and flexible spending accounts, auto allowance, education program which includes tuition/course reimbursement and paid time off to take approved courses, vacation, sick leave, holidays, flexible personal time off, plus time off between Christmas day and New Year’s day.

HR Assistant

Human Resources Assistant
Based in: Headquarters (City of Industry, CA)

POSITION SUMMARY:

Under direction of the Human Resources Director and/or their designee, the Human Resources Assistant will assist with daily HR function. Interfaces with Management, Employees, Affiliates, and Vendors. Contributes to the attainment of specific goals and results of the HR department and the organization. Maintains confidentiality in work-related matters, as this position involves access to confidential information, including but not limited to personnel files and labor relations information. Non-Bargaining unit position.

ESSENTIAL DUTIES (include but are not limited):

  • Assists with HR related inquiries, tasks, projects and/or requests
  • Obtains and/or processes employee documents and information essential to the HR process (i.e. I-9, W4, DE4, Accident/Incident reports, Paystubs, attendance records, etc.)
  • Audits records to determine compliance with union contract language and/or UNAC/UHCP policies
  • Assists with confidential analysis for labor negotiations
  • Performs data-entry, filing (hard and soft copies), emailing, and scanning of sensitive documents effectively
  • Works with HR Director and management to coordinate meetings, interviews, trainings, site-visits, events, activities, (including logistics, vendor liaison, scheduling, travel arrangements, document preparation and follow-up work)
  • Utilizes various data systems or computer programs to archive, input, import, export, track, monitor, cross-reference and report data
  • Coordinates company-issued leased vehicles purchase/transfers/returns and associated insurance policies
  • Coordinates company-issued property, including but not limited to cell phones, laptops, keys, ID cards, system access, etc.
  • Communicates with vendors and or third-parties to fulfill requests
  • Assists in performing internal audits
  • Assists in preparing information for external audits
  • Process, distribute, and/or transfer HR related mail, calls, and/or correspondence to appropriate person
  • Liaise with other departments or functions (payroll, finance, etc.)
  • Assist with new employee orientations and onboarding
  • Works with vendors and technicians to coordinate repairs, inspections, etc.
  • Perform other work as assigned/required to support the mission of UNAC/UHCP

MINIMUM QUALIFICATIONS:

  • Minimum three (3) years general HR work experience, or one-year temporary employment with UNAC/UHCP, or a B.A. or B.S. in a relevant field
  • Knowledge of human resources processes and best practices.
  • Ability to understand and interpret employee union contract agreements
  • Ability to learn new administrative skills, technology, and programs as they evolve/emerge to support the organization’s goals
  • Ability to work well independently, prioritize, multi-task, problem-solve, and complete assignments effectively and efficiently, with attention to detail
  • Ability to take direction from management
  • Proficient in using the internet as a search tool
  • Competent in using Adobe PDF and MS Office (MS Outlook, MS Excel, MS Word, and MS PowerPoint, in particular).
  • Experience with HR databases (ADP, PayChex, FMLA Mgr, etc) a plus
  • Ability to handle confidential information
  • Professional attitude and attire
  • Ability to communicate and interact professionally and effectively with UNAC/UHCP officers, staff, affiliate leadership, union members, vendors and guests
  • May be temporarily reassigned to another UNAC/UHCP office and/or project office, as needed

  • Ability to type 45 wpm proficiently/accurately
  • Ability to lift up to 25 lb. mailing trays, safety equipment, storage boxes

Staff Representative - KWHPA

Staff Representative – KWHPA
Based in: Headquarters (City of Industry, CA)

POSITION SUMMARY:

This position represents members within the Kaiser West Los Angeles Healthcare Professionals Association (KWHPA) affiliate and is responsible for guiding and advising the affiliate officers and members; building leadership, activism and solidarity; representing and advancing the Union in our members’ workplaces; negotiating and enforcing collective bargaining agreements; handling, negotiating and resolving grievances and other disputes; and supporting, educating and providing direction to Affiliate officers and representatives.

ESSENTIAL DUTIES (include but are not limited):

  • Promotes solidarity and collective bargaining, builds bargaining power, identifies workplace injustices and grievances, and increases membership and member activism
  • “Plans for, develops proposals for, and conducts negotiations for collective bargaining agreements, in collaboration with Affiliates and UNAC/UHCP’s officers and other staff members.”
  • Identifies, investigates, drafts, files, pursues and resolves workplace disputes, including grievances and other injustices; negotiates resolutions to such disputes; and processes grievances up to and including arbitration and/or mediation
  • Responds to Affiliate officers and representatives, and members’ needs, including workplace meetings, grievance handling, problem solving and making rounds. Deploys Union resources for assigned Affiliate(s) and members
  • “Responds to telephone calls from members, Human Resources and management representatives in a timely manner.”
  • Conceptualizes, plans for and conducts internal organizing to increase membership, activism, leadership and bargaining power.
  • Organizes, recruits, trains, orients, develops and assists activist members and leaders in assigned Affiliates in order to empower them to achieve goals described above through solidarity, activism, and leadership
  • Conceptualizes, plans and implements new initiatives to achieve goals and duties described herein
  • Attends assigned Affiliate(s) general membership meetings when invited or necessitated.
  • Formulates and participates in Union educational activities (teach, backup, support as appropriate).
  • Participates in Union activities as a representative of UNAC/UHCP i.e. Central Labor Councils, leafleting, picketing, etc.

MINIMUM QUALIFICATIONS:

  • Current, active RN, NP, PA, OD, PT or OT License or other appropriate professional license; if no healthcare professional license, B.A. or B.S., in a relevant field or background in labor movement and/or progressive movement.
  • Good standing with BRN or appropriate licensing agency (if applicable).
  • Understanding of current Collective Bargaining Agreement(s).
  • Good interpersonal skills, ability to communicate and interact effectively with Affiliate leadership and Union members.
  • Ability to work well independently, manage multiple projects simultaneously and meet deadlines.
  • Salaried position; may require nonstandard work hours and/or weekend and holiday work.
  • Extensive travel may be required; valid current California Drivers License.
  • Background in labor movement and/or progressive movements

Salary $84.541/hr– $105.122/hr. We provide a comprehensive package including medical and dental benefits for employee and dependents, optical allowance for employee and dependents, life Insurance for employee, defined benefit pension plan, 401K and flexible spending accounts, auto allowance, education program which includes tuition/course reimbursement and paid time off to take approved courses, vacation, sick leave, holidays, flexible personal time off, plus time off between Christmas day and New Year’s day. This position is covered by a Collective Bargaining Agreement with United Nurses Staff Union (UNSU). Salaries and benefits are subject to change based on future Collective Bargaining Agreements.
