2025 BOD Special Election Notice

Because of a recent vacancy on the Board of Directors (BOD), the UNAC/UHCP Executive Council approved the election process to fill the position during their meeting on January 11, 2025. The elected individual will serve the remainder of the term and will be eligible for re-election at the 2026 UNAC/UHCP Convention.

UNAC/UHCP BOD Nomination and Election Overview

Nominations open 1/28/2025 and close 2/11/2025

  • Nominations: The BOD nominations will be open for 2 weeks. They open on Tuesday, January 28, 2025, and close on Tuesday, February 11, 2024.
    • Nominees must be members of the Executive Council. Nominations can be submitted directly starting January 28th
    • Online Form: 2025 BOD Special Election- Nomination Form  https://bit.ly/2025BODSpecialElectionForm
    • The nominees’ names will be posted on the UNAC/UHCP Election website on February 12, 2025. This will not be the final list of candidates. Some nominee names can be removed if they do not meet the eligibility requirements. The challenge period begins on February 12, 2025, at noon (PT)/9:00 AM HT and ends on February 19, 2025, at noon (PT)/9:00 AM HT.
  • Voting Representative: 1 VOTING Representative that is an elected member of the Executive Council and is a member in good standing, per Article 3, Section 301 of the 2024 State Constitution, will be appointed by each UNAC/UHCP Affiliate/Chapter to cast one vote per affiliate/chapter.
    • Submit your Affiliate/Chapter VOTING Representative by March 1, 2025 (one submission per affiliate/chapter)

    • The designated VOTING Representative will receive voting keys via email and text at the email address and cell phone number provided on the form.
  • Secret Ballot Election: The election will be conducted on Saturday, March 8, 2025, and the appointed Voting Representative will cast their vote on behalf of their affiliate/chapter.
    • Only one (1) vote per affiliate/chapter will be cast to remain fair and equitable.
    • Executive Council members should thoroughly review the candidate names and bios on the UNAC/UHCP election website and the March Executive Council packet, ensuring a transparent and informed decision-making process.
    • Candidate speeches (3 minutes each) will be conducted in-person or virtually before voting.
    • If time permits, a period/break between speeches will be allowed.
    • Affiliate Officers/Chapter Representatives must collectively decide on their BOD candidate at the March 8th UNAC/UHCP Executive Council Meeting.
    • The voting will begin approximately at 11:00 am once speeches are concluded.
    • The designated Voting Representative will then cast the vote.

 

Constitution Language: 2024 UNAC/UHCP State Constitution

Article 3, SECTION 301

A. Qualifications for Membership:

  1. A Registered Nurse properly licensed in accordance with appropriate state laws; or a Health Care Professional other than a Registered Nurse, within the meaning of Section 2 (12) of the National Labor Relations Act, engaged in health care delivery.
  2. A member of a Chapter of Health Care Employees, bargaining unit(s) of health care employees outside of the state of California.

B. Member in Good Standing: 

To maintain good standing in the State Association, a member must pay dues monthly, initiation fees, if any are owed, and such other financial obligations as and when they may become due to the State Association. No person shall be entitled to the rights and privileges of membership until his/her dues and initiation fees are current.

Article 7, SECTION 703

When either a temporary or permanent vacancy occurs in the Directors between Conventions, the Executive Council shall elect a member of the Executive Council members to fill such vacancy until the term expires. The Executive Council shall have the power to determine how the election of a member to fill the Director(s) position shall be conducted. The Executive Council shall designate a member of the Executive Council to serve as chairperson to coordinate the election process.

ARTICLE 6, SECTION 606

No member shall be eligible for nomination or election to a State Association or Board of Directors office unless the person:

  1. Is a member in good standing who has fulfilled the requirements for membership and who has not voluntarily withdrawn nor been expelled or suspended by the union for a period of two (2) years immediately preceding the election;
  2. Has practiced the profession of nursing, or is a health care professional, or is a health care employee, engaged in health care services for at least three (3) years;
  3. Has been a member of any UNAC/UHCP Affiliate or Chapter for at least two (2) years; and
  4. Is not a current steward; bargaining team member; affiliate, chapter, or local officer; executive board officer; elected or volunteer representative; or hold any leadership or representative role in a bargaining unit represented exclusively by a rival union or labor organization (except United Nurses Staff Union). Even if a member is otherwise eligible for nomination or election, the member is ineligible to seek or hold a State Association office when the member is, at the time of their nomination, a steward; bargaining team member; affiliate, chapter, or local officer; executive board officer; elected or volunteer representative; or hold any leadership or representative role in a rival labor organization, other than UNAC/UHCP or an Affiliate or Chapter. A “rival union or labor organization” is one which, within the past twenty (20) years, is known to have filed or made any representation petition, recognition demand, or any other affirmative step (including any claim under Article XX or XXI of the AFLCIO Constitution, or under the Kaiser Permanente partnership, or any other alternative dispute resolution procedure), to seek representation of part or all of any bargaining unit then represented or then sought to be represented by UNAC/UHCP, or by any union belonging to the Alliance of Health Care Unions, or by any local, district, or affiliate of any of the above, or that has filed, supported, or threatened to file any unfair labor practice charge or lawsuit in that time period against UNAC/UHCP or any of its State Officers where the aim or possible outcome of such a charge or lawsuit would destroy or impede UNAC/UHCP’s ability to represent employees in any bargaining unit. If such union or labor organization took any of the above steps through an authorized agent, such will be treated as having been taken by the union or labor organization itself.
  5. No person who is or has been defined in Section 504 of the Labor-Management Reporting and Disclosure Act of 1959.
